Please be placed on notice that FRANCIS E. DOSAL, DISTRICT CLERK has been served copy of CYBERGODS via U.S. Cerified Mail No. P-076329-115 and a three page letter to U.S. SENATOR Jesse Helms & the Foreign Relations Committee, Fernando Henrique Cardoso the President of Brazil, Jane's Information Group and His Eminence Arch Bishop Iakovos.
The letter and manuscript CYBERGODS is to be considered by your office in the preperation of an updated presentence investigation report (PSI) pursuant to Rule 32 for my resentencing.
I do not understand the current delay for a competency evaluation and evidenciary hearings on information that has been submitted to the Clerk of Court and the U.S. Attorney's Office. As you know, Rule 32 (a)(1) of the Federal Rules of Criminal Procedure mandates that a court impose sentence without unnecessary delay. Prejudice is occurring due to the fact I have implants that are torturing and controlling me daily which will be proven at a competency hearing and evidenciary hearing.
Remember Federal Rule of Criminal Procedure 32(c)(1) states:
Once a defendant makes an allegation of factual inaccuracy, the government bears the burden of showing the alleged fact's accuracy. See U.S. vs. DENINNO, 29 F.3d 572, 580 (lOth Cir 1994) (defendant bears burden of alleging factual inaccuracies but GOVERNMENT BEARS BURDEN OF PROOF), cert. denied, 115 S. Ct. 1117 tl995).
